On December 22, 2023, Anthem submitted Gag Clause Prohibition Compliance Attestations on behalf of their fully insured clients for the benefits they administer and maintain. ASO clients who completed the opt-in form were also included in the attestation submission for the benefits Anthem administers and maintains. The attestation includes active clients through October 31, 2023.
The gag clause provision of the Consolidated Appropriations Act (CAA) requires group health plans and issuers to submit an attestation each year to confirm compliance with the restriction on gag clauses. This first attestation covers the period between December 27, 2020, or the effective date of the group health plan, through the date of attestation.
Anthem is committed to the timely implementation and execution of these regulations for their fully insured and self-insured employer groups. Anthem will continue to provide updates as they receive more regulatory guidance.
