This is the first year that a group attestation is required for the Gag Clause prohibitions under the CAA. The attestation is due by the end of the year, and AZ Blue will automatically complete it on behalf of all group clients by November 30th, except for self-funded groups that opt out.
Here is some background information:
The Gag Clause prohibitions under the Consolidated Appropriations Act (CAA) relate to language that is not allowed in provider agreements which would otherwise restrict providers from releasing, accessing, or sharing certain information. It is not new. This is just the first year that a group attestation is required.
If your employer groups want to complete the attestation on their own and are self-funded, they should notify AZ Blue immediately.
